SENTENCE ON BACH DANG GIANG FOUNDATION


Mr. Pham Ba Hai, founder of Bach Dang Giang Foundation, while having studied at University of Delhi in India, recently released from prison after five years but still faced two years of probation.
Narrating with Thanh Truc (RFA) about causes and the judgement process of Bach Dang Giang case for which he affirmed it unjust and absurd, Pham Ba Hai firstly presented the guideline of the organization which he founded after some years when he was forced to repatriate to Vietnam from refugee camp in Thailand:

Founded for humanitarian aids.
"Bach Dang Giang Foundation basically is a fund, a charity foundation for humanitarian aids that I established during my studying and working in India.
The objective of the foundation is to voice the truth about the situation of the country's development, promotion and spread of liberal democracy and human rights. The second objective which is originated from complaints about a common problem in Vietnam that is the situation of workers’ low wages and working conditions’ unhealthiness, life in general is very difficult, so I had a bias of setting up an independent trade union.
The third objective is the Bach Dang Giang Foundation attempts to support war invalids of the Republic of Vietnam before 1975 but now they are still alive. And the fourth is to support, provide scholarships, jobs and vocational training for those people who directly were forced to return from refugee camps. In addition, I also pointed out other categories we do is a support for victims of unjust society, of imperfect mechanism in which the injustice have occurred. That is the outline of the foundation I set up in 2005 after my graduating Master degree in India."
Of a second trip back home in 2006, during preparing doctoral thesis in India, Mr Pham Ba Hai was banned for visa exit at Tan Son Nhat airport on the way back to India:
"With that trip I brought FDI on production of shoe leathers that I was working for to recruit primarily some employers and to establish a representative office of investment. After two weeks in Vietnam, I returned to Singapore but I have been banned and then arrested."
At that time, police did not explain why the visa exit was banned but said that they invited him to the Department of Immigration of Ho Chi Minh City on Nguyen Trai Street:
"When coming there, I was said my case was banned for reason of the national security, a few days later I was interrogated repeatedly and still unresolved yet. They slandered me about things that I could not imagine, said that I was a terrorist in Kashmir, North India and attempted bringing it to Vietnam".After those investigations, Pham Ba Hai said he and some friends in Bach Dang Giang Foundation including democracy activist Le Tri Tue, democracy activist Nguyen Ngoc Quang, writer Du Lam Tan Vinh Phat, took a tour from South to North:
"Arriving Hue, we visited Father Nguyen Van Ly, it was the time of Nguyen Ngoc Quang’s arrest. I with Tue went to Hai Phong and then we continued to visit Tran Anh Kim in Thai Binh. As soon as out of Mr. Kim’ house I was arrested. In Hue, they sticked a label on my works as bandit activities, and in Hai Phong they had allegedly letter of denunciation against me with Tue for looting bikes and snatching. In Thai Binh before they arrested me, they forced our bike stopping along the roadside and they told me they suspected we were peddling drugs. But in the public hearing, they accused me of propaganda against the state."
Nguyen Ngoc Quang who had fled from Vietnam after his three years of imprisonment gave details of why only he was arrested amongst Bach Dang Giang Foundation members in visiting Father Nguyen Van Ly in Hue:
"On 2 September 2006, I and Mr Pham Ba Hai, Mr Le Tri Tue, Mr Du Lam Tan Vinh Phat, four of us went to Hue to visit Father Nguyen Van Ly. While leaving, there were many secret police sieged there. Policemen were too crowded so I said that you all seek a safe shelter to continue the journey, and I will mislead them by running away with my bag. I had a motortaxi run very fast to attract security team following me. When a group of twenty-one men caught me in Huong So Commune, Mr Pham Ba Hai and Mr Tue could go to the North. Mr. Du Lam Tan Vinh Phat had to return to Da Nang because he had children, and his family was harassed severely by Danang’s provincial authorities.
 On 7 September 2006, going out from Mr Tran Anh Kim 's house in Thai Binh, Mr Tue and Mr Hai  were arrested. Because of insufficient evidences after a period of custody at B34, Mr Tue was released and he fled to Cambodia.
Unfortunately, in Cambodia Le Tri Tue was kidnapped, until now he is unknown whereabouts. When I escaped from Vietnam and have met some colleagues, they said that Mr.Tue was arrested by security agent Nguyen Cong Cam in Cambodia. He was in custody or killed they do not know.
Mr. Pham Ba Hai was convicted of propaganda against the state.Returning to the case of Mr. Pham Ba Hai, when being arrested in Thai Binh, he was taken to prison B4 in Hanoi, and then transferred to Ho Chi Minh City for further judgement. On 25 April 2008, in the trial court of Ho Chi Minh City he was sentenced five years' imprisonment and two years’ probation on charge of propaganda against the state. Pham Ba Hai had appealed. On August 8, 2008, the appellate court rejected his appeal and kept the 5 years of imprisonment and 2 years of probation.
After 25 months' solid detention in prison B34 of Ho Chi Minh City, Pham Ba Hai was transferred to prison Z30A of Xuan Loc, Dong Nai and labored there until the end. On 7 September, Mr Pham Ba Hai ended his 5 years from prison. Last weekend, September 11, with the paper of releasing he had presented the village police station.
“Village police said with me that for the probation matter, I have to wait for the District Police. I have still been waiting for their sending an invitation letter of the District Police to work out that problem. Three days ago they guided me to make ID card."
Then he told that he was advised to strictly observe the regulations of two years’ probation, he must regularly report to police and not goes anywhere without permission.
Therefore among four persons of Bach Dang Giang Foundation for which police had followed and arrested for pro-democracy activities as well as connections with other dissidents, Mr. Pham Ba Hai was sentenced longest as the result of the organization founder.
According to Mr Nguyen Ngoc Quang, with the initial principles of Bach Dang Giang Foundation aimed at promoting, disseminating thoughts of liberty, democracy and human rights and supporting to establish an independent trade unions, i.e. sensitive matters to the government, Mr Pham Ba Hai will have no hope to go to India for following up Ph.D. research after two years of probation.
